Od sierpnia mam pod swoją opieką córkę znajomych (pełnoletnią) która poszła we wrześniu do college i starała się dla siebie o EMA. We wniosku podaliśmy nasze dane ze względu iż jest pod naszą opieką. Otrzymaliśmy niestety odmowną decyzję. Powodem są niespełnione kryteria dotyczące rezydentury.
Patrzyłam na tą stronę i nie znalazłam nic na temat wwmogów dotyczących rezydentury. Mój angielski jest kiepski więc mogłam coś przeoczyć. Ponadto 2 lata temu o EMA starał się mój syn i dostał go bez problemu mimo, że w Anglii przebywał niecałe pół roku.

Wie ktoś z was czy coś się zmieniło w tej kwestii? Albo gdzie znajdę dokładne kryteria przyznania EMA?

EMA criteria:
Household income:

up to - £20,817 per year - £30 per week
£20,818 - £25,521 per year - £20 per week
£25,522 - £30,810 per year - £10 per week
You must be between the ages of 16-18.

Residency:


In order to meet the EMA residency criteria the young person must be:

settled in the UK, and been ordinarily resident in the UK for at least 3 years prior to the start of your learning programme
a national of any European Union (EU) country or the spouse or civil partner or child of an EU national, and ordinarily resident in the European Economic Area (EEA) for at least the three years prior to the starting of your learning programme
an EEA migrant worker or the spouse or civil partner or child of an EEA migrant worker, who is ordinarily resident in the UK at the start of the learning programme and has been ordinarily resident in the EEA throughout the three year prior to that
recognized as a refugee by the UK Government, or the spouse or civil partner or child of a refugee, have been granted Humanitarian Protection, or have EU Temporary Protection

Studies:


You must be undertaking or applying to do a course of a minimum of 10 weeks with at least 12 guided learning hours a week. This includes a wide range of courses up to and including level 3, such as AS/A2, GCSEs, GNVQs, NVQs and other vocational qualifications.

How do I apply?
If you are currently receiving EMA the Assessment Payment Body, APB, will contact you with further details. It is very important that you reply and provide all the information you are asked for.

Information for first time applications:

Application forms are available from schools, colleges or by phoning 0800 121 8989
You will need to open a basic bank account.
When you apply for EMA you will need to send information regarding your bank or building society account.
Your parent or carer will need to provide evidence of your household income for the previous tax year. Further details are available from 0800 121 8989 or www.direct.gov.uk/ema
If you start your course in September and the APB receives your application by 30th September you will be eligible for payments from the start of your course.
Applications received from October 1st onwards are eligible for payment from the Monday of the week the application was received .
Once your application has been assessed, you will receive a Notice of Entitlement, NoE, explaining how much you will receive every week.
Take your NoE to the EMA office in the Student Information Centre at college, along with your Student ID Card. You will be given an EMA Student Learning Agreement to read, sign and hand in. Staff will explain the EMA procedures to you and supply you with a weekly attendance timesheet and a copy of your Student Learning Agreement.
How will I get paid?
If you are entitled to payment Canterbury College will inform the Assessment Payment Body, APB, who will release payment into your bank account
The allowance for the week will be paid in full provided that you supply your current weekly timesheets, fully completed, to the EMA office, before 10am on the following Monday, for payment by close of business Friday, systems permitting. Timesheets can be handed in as soon as your classes are finished for the week. (The EMA office hours are Monday - Wednesday 8.45am – 5.15pm Thursday 10.00 – 5.15 and Friday 8.45am– 4.30pm).
Timesheets handed in after 10am Monday will be paid within 2 weeks.
Payments will begin on submission of completed timesheets.
Your attendance will be monitored by the EMA team on a regular basis.
Other Information:
Timesheets
You will need to complete timesheets on a weekly basis and ask your tutor to sign and enter an attendance code at the end of every class. All timetabled sessions must be noted on your timesheet. Please note that only tutors can complete attendance codes and tutor signatures.

Timesheets completed with a ‘UA’ (unauthorised absence), ‘UB’ (unacceptable behaviour or ‘AA’ (authorized absence) for a full week, will result in non-payment of EMA for that week.

Individual arrangements regarding timesheet procedures can be made for students with Learning Difficulties or Special Needs.

Attendance
You will be paid your weekly allowance for attending all your timetabled lessons. For an absence to be considered authorised (see Student Learning Agreement for list of acceptable authorised absences) you must inform your tutor(s) in advance. Where absences cannot be foreseen you should make arrangements to inform your tutor(s) as soon as possible on the first day of absence. Failure to inform your tutor(s) will result in a ‘UA’ on your timesheets and non payment of EMA .

Lateness
Unauthorised lateness is considered to be an unauthorised absence.

Fraud
Please note attendance codes and lecturers signatures completed by you, or timetabled lessons missing from the timesheet will be class as FRAUD.
Fraudulently completed timesheets will be reported to the Finance Department of the College and the EMA Payment Body.
The penalty for fraud is:
1 week’s fraud – 2 week’s loss of money
2 week’s fraud – 6 week’s loss of money
2 week’s + fraud – 12 week’s loss of money.

FRAUD IS TREATED VERY SERIOUSLY BY THE COLLEGE.

Appeals against non-payment
If your claim for payment is rejected you will receive a non-payment letter from the EMA team. You can appeal against the decision and details of the appeals process are in your EMA Student Learning Agreement.

Dzięki Ada. Nie wiem czy to dobrze sobie przetłumaczyłam ale jeśli mój mąż przebywa tu 5 lat to kryteria dotyczące rezydentury zostały spełnione. Dobrze rozumiem? Jej tata zresztą też jest tu już 5 lat.
