Your partner/husband has the right to stay in the United Kingdom under the EEA 2006 regulations. Unfortunately the not every case worker at the Home Office understands the right of an EEA family member. Infact, you dont have to be married for him to reside in the UK legally as the family member of an EEA national and whatever way he came to reside in the UK does not affect his right as your family member, coupled with the fact that you guys have children together. They cannot tell him to leave the UK for any reasons. he is your family member, you are POLISH and as such an EEA national possibly exercising EEA treaty rights here in the UK. I am no a Solicitor but God made me a Solicitor naturally and as such i know the laws that govern the EEA regulations which your partner/husband has a RIGHT to apply under as your family member. He should apply for a Residence card of a family member of an EEA national. If you are working, it is a massive advantage for his application as you will have to add letters from your employers, your kids birth certificates if they were born here in the UK, your pay slips and every single relevant document to the application as the Home Office always tends to find out how you have really integrated into life in the UK by yourself and as a family together. So every detail and every document is necessary. I tell you, he WILL stay in the UK because he has that RIGHT. It is not a privilege, IT IS A RIGHT. You have to understand this very well and INSIST on your right. They CANNOT separate you especially now that kids are involved. I know exactly what i am saying to you because i passed through that route extremely successfully too. I have 2 sons with my POLISH partner and i have NEVER been to Poland before, but i am settled in the UK and even have a Housing Association flat already. Again, if you as a Polish citizen have resided in the UK for 5 years, it is wise for you to apply for a Permanent Residence Card as this will quicken your partner/husband's immigration status in the UK. take your advantage to yourselves by yourselves and include your kid's POLISH passports too in every application. If you have been here residing for 5 years and your kids were born here in the UK, your children now have a RIGHT as BRITISH citizens too. Read the Home Office website, every right and laws to support your application is there. And if you have to contact me personally for assistance and/or guidance, email me at nwebube@yahoo.com I live here in South London. Thank you.

But remember, i am not a Solicitor. Solicitor's will only take your money and do nothing for you. Make your application by your own self. God bless ya.
